These terms and conditions apply to the HeloChecklist app (hereby referred to as "Application") for mobile devices and Apple Watch, created by ercanay ceran (hereby referred to as "Service Provider") as a freemium service.
Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application.
1. Acceptance of Terms
By downloading, installing, or using the Application, you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Application.
2. Aviation Safety Disclaimer — Important
The Application is designed as a supplementary digital tool to assist qualified pilots during flight operations. It does not replace, supersede, or substitute any official publication, technical manual, flight manual, operator's checklist, or regulatory requirement applicable to any aircraft type.
Specifically:
- The checklists contained in this Application are based on publicly available reference material and are provided for informational and training aid purposes only.
- The Application does not replace the official U.S. Army TM 1-1520-237-10 or any other applicable operator's manual, technical manual, or unit SOP.
- Pilots are solely responsible for verifying the currency and accuracy of all procedures against official publications prior to any flight operation.
- The Service Provider accepts no liability whatsoever for any incident, accident, injury, death, or loss of any kind arising from reliance on the Application during flight operations or any other activity.
- The Application must not be used as the sole reference for any flight procedure. Official printed checklists and publications must always be carried and used as the primary reference.
Use of this Application constitutes your acknowledgment that aviation operations involve inherent risks and that you assume full responsibility for all decisions made during flight operations.
3. Intellectual Property
Unauthorized copying or modification of the Application, any part of the Application, or its trademarks is strictly prohibited. Any attempts to extract the source code, reverse engineer, translate, or create derivative versions of the Application are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.
4. Subscriptions and In-App Purchases
The Application offers optional premium features through an auto-renewing subscription available in monthly and annual plans. By purchasing a subscription you agree to the following:
- Subscriptions are billed through your Apple ID account via the App Store.
- Your subscription automatically renews at the end of each billing period unless cancelled at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the price confirmed at purchase.
- You can manage and cancel your subscription at any time through your Apple ID account settings at Settings → [Your Name] → Subscriptions.
- No refunds are provided for partial subscription periods. Refund requests are handled exclusively by Apple Inc. in accordance with Apple's refund policy.
- The Service Provider reserves the right to change subscription pricing at any time. Price changes will be communicated in advance and will not affect the current billing period.
- Free trial periods, if offered, will convert to a paid subscription automatically at the end of the trial unless cancelled beforehand.
- Access to premium features will cease immediately upon subscription expiry or cancellation.
5. Crew Sync Feature
The Crew Sync feature enables two pilots to share checklist state, engine timer data, and mission information in real time over a direct peer-to-peer Bluetooth or local WiFi connection. By using Crew Sync you acknowledge:
- Data is transmitted directly between two devices without routing through external servers.
- Both pilots must explicitly consent to the session by accepting the connection on their respective devices.
- The Service Provider is not responsible for data loss, incomplete synchronisation, or any operational consequences arising from connectivity interruption during Crew Sync use.
- Crew Sync is a convenience feature and does not constitute a certified crew coordination system. Each pilot retains individual responsibility for their own checklist completion and aircraft operation.
6. Navigation Data and Offline Maps
The Application provides navigation aids, airport data, and map tiles for informational purposes only.
- Navigation aid data is sourced from OpenAIP and is refreshed per AIRAC cycle. The Service Provider does not guarantee the accuracy, currency, or completeness of this data.
- Offline map tiles are sourced from NASA and ESRI services. Imagery may not reflect current terrain, obstacles, or airspace conditions.
- GPS-derived navigation calculations (bearing, distance, ETE) are estimates only and must not be used as the sole means of navigation.
- The Application does not provide real-time airspace information, NOTAMs, TFRs, or obstacle data. Pilots are responsible for obtaining current aeronautical information from official sources prior to flight.
7. Device and Connectivity
The Service Provider does not assume responsibility for the Application not functioning due to:
- Lack of internet connectivity for features requiring online access.
- Device battery failure during operation.
- Incompatibility with future operating system versions.
- Data charges incurred when using the Application outside a WiFi area, including international roaming charges.
Some features of the Application function without internet access. Features requiring connectivity (weather data, online map labels, navaid data refresh) will not function without an active internet connection.
8. Export and Jurisdictional Compliance
The Application contains procedural information derived from TM 1-1520-237-10, a U.S. Army technical manual approved for public release under Distribution Statement A — distribution is unlimited. This document is freely available to the public with no access restrictions. Users are solely responsible for ensuring that their use of the Application complies with all applicable local, national, and international laws and regulations, including any export control regulations applicable in their jurisdiction.
9. Modifications to the Application and Terms
The Service Provider reserves the right to:
- Modify, update, or discontinue the Application at any time without notice.
- Update these Terms and Conditions at any time. Continued use of the Application after any change constitutes acceptance of the updated terms.
- Charge for services or modify pricing with reasonable advance notice.
Upon termination of these terms for any reason, your right to use the Application ends immediately and you must delete it from your device.
10. Disclaimer of Warranties
The Application is provided "AS IS" without warranty of any kind, express or implied. The Service Provider makes no warranty that the Application will be error-free, uninterrupted, or free of security vulnerabilities. To the fullest extent permitted by applicable law, the Service Provider disclaims all warranties including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the fullest extent permitted by applicable law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, personal injury, or death arising from your use of or inability to use the Application. In no event shall the Service Provider's total liability exceed the amount paid by you for the Application in the twelve months preceding the claim.
